This Policy does not cover the personal information we collect about employees and independent contractors, or job applicants.

When we engage in digital advertising, we may sell the following categories of personal information (according to the broad definition of “sell” under select state privacy laws), share them for purposes of cross-context behavioral advertising, or use them for targeted advertising: Personal identifiers (including, without limitation, email address, name, IP address, mobile advertising IDs); Commercial and financial information; Internet or other electronic activity information; and Inferences about you.

These categories of personal information are sold to or shared for cross-context behavioral advertising or targeted advertising with advertising networks, data brokers and other companies that facilitate or engage in digital advertising. We engage in such sales and sharing to facilitate personalized advertising.

We also use the Shopify platform and Shopify may use the personal information it collects from our website to facilitate personalized advertising and share it with third parties (including those that may be located in other countries) in a way that may constitute a sale of personal information or the sharing your personal information for targeted or behavioral advertising. The categories of personal information Shopify collects and may use in this regard are: contact and profile information; device information including IP address, device identifiers, browsers you use; payment information; commercial information about products you view, purchase, review, or rate. We do not sell or share for cross-context behavioral advertising any of the other categories of personal information we collect.

Categories of Third Parties To Whom We Disclose Personal Information

We disclose personal information to the following categories of entities that do not operate as our service providers, processors and are not our affiliates: Advertising networks, social media companies, and data brokers, for purposes of providing advertising and marketing services to us and other parties.

Sources From Which We Collect Personal Information

We collect personal information directly from our customers, website users, social media platforms, and representatives of entities with which we do business or may do business. We also collect personal information from social media companies, data aggregators and data brokers.

Data Collected from Meta (Facebook, Instagram, etc.) - Data Deletion Rights

In connection with providing our services, from time to time, we may obtain data from Meta (the parent of Facebook and Instagram, among other apps and services) about users, which may include contact information, Meta identifiers and usernames. This data allows us to use Meta services to reach you and to understand your engagement with us, and also facilitates easy log-ons through Facebook. If you would like us to delete the data we receive from Meta, please contact us at info@carawayhome.space and provide us with your request, name, and email address. We may follow up with additional questions if we need to verify or confirm your identity. Please note, this right to delete applies broadly and can be exercised by all users who interact with us; it is not limited to residents of states or other regions with data privacy laws.

Use or Disclosure of Sensitive Personal Information

We do not collect, use or disclose sensitive personal information to create profiles about or infer characteristics about individuals, or for any purposes other than providing our Services.

No Profiling to Facilitate Decisions with Legal or Other Significant Effects

We do not engage in the automated processing of personal information to create profiles about individuals that are used in furtherance of decisions with legal or other similarly significant effects, such as the provision or denial of financial or lending services, housing, insurance, or access to essential goods or services.

We use Google Analytics to evaluate the use of our website. Notice of Financial Incentive – Our Rewards Program

We offer the Liquid Death Country Club that provides certain perks, such as rewards, discounts, and exclusive offers (the “Country Club”). When you sign up for the Country Club, we will ask you to provide your name and email address. Under California law, the Country Club might be interpreted as “financial incentive” programs as they involve the collection of personal information. We do not assign a monetary value to the information we collect, although sometimes we joke that its worth $125,000. Based on our reasonable estimate, the value of your personal information to us is related to the value of the free or discounted products or services that you obtain when you join the Country Club. This value, which we estimate to be $20-$50, is based on the expense related to offering those free or discounted products or services. You may withdraw from participating in the Country Club at any time by contacting us info@carawayhome.space. Visit the Country Club page to view full program details, including how to join.

You may withdraw from the rewards program at any time. You can do so by clicking the “unsubscribe” link in our emails or by contacting us using the information provided in the “Contact Us” section below.

Personal Information of Minors

Our products and website are not directed to minors under the age of 13 and we do not knowingly sell or share for purposes of behavioral advertising the personal information of minors, including minors under 16 years of age.

SMS Terms and Conditions

Information obtained as part of SMS or text messaging consent will not be shared with third parties or affiliates; it will only be shared with service providers that operate our SMS/text messaging service for the purpose of providing that service. 

If you have consented to receive text messages from us, you may receive text messages about discounts or product offerings.  Message rates may apply and messaging frequency may vary.  You may opt out of text messages by texting STOP to the number that texted you or click the unsubscribe link where available.  For additional information, text HELP to the number that texted you or email info@carawayhome.space. 

You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through our text messaging program, any errors in such information, and/or any action you may or may not take in reliance on our program. Additionally, wireless carriers are not liable for delayed or undelivered messages.

Third Party Websites and Platforms

Our website may contain links to third-party websites or platforms, including social media buttons that link to social media platforms. This Policy does not govern how those third parties or social media platforms collect or use personal information and we do not endorse or have control over their practices. The privacy policies and terms of use for those third parties’ websites/apps or social media platforms govern those companies’ privacy practices. We are not responsible for the content or privacy practices of any third-party websites or platforms.

Securing Your Personal Information

We implement and maintain reasonable security appropriate to the nature of the personal information that we collect, use, retain, transfer or otherwise process.  However, there is no perfect security, and reasonable security is a process that involves risk management rather than risk elimination.  Accordingly, it cannot be assumed that the occurrence of any given incident or breach results from our failure to implement and maintain reasonable security.

Changes to This Policy

We will review and update this Policy from time to time. If changes are made, we will update the Privacy Policy and reflect the date of such modification in the date above. If the changes are material, you will be notified via email or a website pop-up.

U.S. State Data Privacy Rights

Consumer Rights Under Comprehensive U.S. State Data Privacy Laws

State privacy laws in the following states give residents of those states (referred to below as “consumers”) various rights with respect to the personal information we collect: California, Nebraska, and Texas. Please note, California’s privacy law applies to all state residents, irrespective of the context in which they interact with us (e.g., a customer, a business contact, a vendor). Laws in other states apply only to consumers when acting in an individual or household context.

California Shine the Light

With reference to California Civil Code Section 1798.83, also known as the “Shine the Light” law, we allow California residents to opt-out of the disclosure of personal information to third parties for those third parties’ direct marketing purposes. To exercise that opt-out option, click here.

Exercising Your Rights

To exercise rights to know, access/copy, delete, or correct, submit a request through our online portal or by contacting us at info@carawayhome.space. If you disagree with our denial of a request, you may appeal our decision by contacting us with the subject line “Appeal.”

Note that, as required by law, we will require you to prove your identity to exercise these rights. We may verify your identity by phone call or email. Depending on your request, we will ask for information such as your name and email address. We may also ask you to provide a signed declaration confirming your identity.

California law permits authorized agents to submit requests to know, access/copy, delete, or correct on behalf of California consumers. If you are an authorized agent submitting such a request, you must submit the request through our online portal, and include a completed Authorized Agent Designation Form (available via the online portal) indicating that you are authorized to act on another person’s behalf.

To exercise opt-out rights, go to the Cookie Settings at the footer of the website. Agents can also exercise opt-out rights for consumers in California, Nebraska, and Texas.

Opt-out Preference Signals and Do Not Track

An opt-out preference signal is sent by a platform, technology, or mechanism on behalf of consumers and communicates a consumer’s choice to opt-out of the sale and sharing of personal information for cross-context behavioral advertising with all businesses that recognize the signal, without having to make individualized requests. The signal can be set on certain browsers or through opt-out plug-in tools.

We recognize the Global Privacy Control (“GPC”) signal for users in California, Nebraska and Texas. If an account holder visits our website with the Global Privacy Control signal enabled when they are logged in, we will endeavor to recognize the GPC opt-out selection with respect to all personal information we collect about the consumer. If the consumer is not an account holder or is not logged into their account when they visit our website, we will only recognize the opt-out preference on the browser and device that transmits the signal.
